Official Rules
NO PURCHASE NECESSARY TO ENTER, PLAY, OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
ELIGIBILITY: To be eligible to enter or win, entrant must be 16 years of age or older and a legal resident of the fifty (50) United States or the District of Columbia at the time of entry. If you are considered a minor or are not the age of majority in your place of residence (a “Minor”), you must have the consent of your parent or legal guardian who must accept these Official Rules on your behalf. Void where prohibited, taxed or restricted by law. Employees of ESPN, Inc. (“ESPN”), Marketing LLC (“GMR”), and of each of their respective agencies, parent companies, subsidiaries, affiliates, promotional partners, sales representatives, and promotion and other vendor agencies involved in this Sweepstakes (collectively “Released Parties”) and the immediate family (defined for the purposes of this Sweepstakes as parents, spouses, siblings, children) and household members of all such employees, are NOT eligible to participate in the Sweepstakes and/or win a prize. Sweepstakes is subject to all federal, state, and local laws and regulations.
SWEEPSTAKES REGISTRATION AND DAILY PLAY ENTRY TIMING:
Sweepstakes Registration Timing: X Games Aspen 2021Sweepstakes ("Sweepstakes") will be open for registration beginning 12:00 am Eastern Standard Time ("EST") on January 23, 2021 and ending at 11:59 pm EST on January 31, 2021. (the “Sweepstakes Period”).
Sweepstakes Daily Play Entry Timing: X Games Aspen 2021 Virtual Games will be available for play daily to earn additional daily entries beginning 12:00 am EST on January 28, 2021 and ending at 11:59 pm EST on January 31, 2021. (the “Game Period”)
HOW TO REGISTER AND ENTER AND PLAY AND ENTER:
To register and enter, complete Official Registration at www.xgames.com/xfest. Provide email address, select “Continue”, then provide first name, last name, password, birth date, postal code, and click “Sign up” or log in to an existing account. Verify via check box, age eligibility and accept the Official Rules and Sponsor’s Privacy Policy during the Sweepstakes Period. Limit one (1) entry per person/authorized registration or log in during the Sweepstakes Period.
To play and enter, complete Official Registration at www.xgames.com/xfest. Provide email address, select “Continue”, then provide first name, last name, password, birth date, postal code, and click “Sign up” or log in to an existing account. Verify via check box, age eligibility and accept the Official Rules and Sponsor’s Privacy Policy during the Sweepstakes Period.
Once registered or logged in, you can play by interacting with each activity game listed below and clicking on the X to earn one (1) Sweepstakes entry each day per activity game.
Limit nine (9) entries per day, one (1) entry per registration or log in and one (1) entry per activity game play per day during the X Games Aspen 2021 Game Period.
Any attempt by any person to submit more than the stated number of entries by using multiple/different accounts or any other methods will void that person’s Sweepstakes entries and that person will be disqualified. Sweepstakes entries must be submitted during the Sweepstakes Period in strict accordance with the instructions and restrictions in these Official Rules. Entries may not be made jointly or by any group and may only be made by an individual. Proof of submitting an entry other than as detailed above (such as a confirmation screen or message) does not constitute actual receipt of the entry for purposes of this Sweepstakes. Administrator’s computer will be the official time clock for each Sweepstakes. All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged or returned. Mechanical reproductions, alterations, incomplete, misdirected, lost, late, forged entries, or entries generated by a macro, bot, or other automated means will not be accepted and are void. Those who do not follow all of the instructions, provide the required information in their entry, or abide by these Official Rules will be disqualified.
DETERMINATION AND NOTIFICATION OF PRIZE WINNERS: Potential Grand Prize winners will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period on or about February 2, 2021 by GMR or Sponsor whose decisions on all matters relating the Sweepstakes are final. Potential Grand Prize winners will be notified on or about February 3, 2021 via email to the email provided on the Official Registration. The Parent or legal guardian of an eligible Minor designated as a potential Grand Prize winner must accept the prize on their child’s behalf. Potential Grand Prize winners must respond to the notification within 48 hours of attempted notification. If a potential Grand Prize winner does not respond to notification within 48 hours of attempted notification, the prize will be forfeited and a potential alternate Grand Prize winner will be selected from the remaining eligible entries submitted, time permitting. Grand Prize winners must complete, sign, and return an affidavit of eligibility, mutually acceptable liability release, and publicity release (where permitted by law), and the appropriate tax documents (the “Documents”) within 7 (seven) calendar days of delivery of the Documents, or the prize will be forfeited in its entirety. Return of any prize/prize notification as undeliverable or failure to accept any prize within the specified time period may result in disqualification and forfeiture of the prize. If a notified winner is not eligible, forfeits prize, or declines prize, an alternate Grand Prize winner may be randomly selected as a potential Grand Prize winner time permitting.
PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): Limit one prize per person during the Sweepstakes Period. Odds of winning depend on the number of eligible entries received.
Two (2) Grand Prizes: Each Grand Prize consists of One (1) Polaris 800 Titan Adventure Snowmobile. All the capability of Titan with a spacious and premium setup for two. Complete comfort for an all-day adventure. Includes: Engine: 800 Cleanfire, Front Shock: FOX QS3, Front Suspension: AXYS Front Suspension, Front Track Shock: FOX QS3, Rear Track Shock: FOX QS3 and Track Width/Length/Height: 20 x 155 x 1.5 Cobra, 20 x 155 x 1.8 Cobra(Prize details to be determined at the sole discretion of the Sponsor); ARV: $15,900 each.
TOTAL ARV OF ALL PRIZES AWARDED IS $31,800.
All federal, state, and local taxes and fees are the sole responsibility of each Prize winner. Prize is nontransferable and no substitution or cash equivalent is allowed, except in Sponsor’s sole discretion. Prize consists only of the items specifically listed as part of the prize. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer’s terms and conditions, and winner agrees to look solely to such manufacturer for any warranty or guarantee claim. Sponsor, in its sole discretion reserves the right to substitute prize of the same approximate retail value.
PUBLICITY AUTHORIZATION: Except where prohibited, entry into the Sweepstakes and/or acceptance of a prize constitutes consent that each entrant’s and Prize winner’s name, image, likeness, voice, address (city and state), statement(s) about Sponsor and/or the Sweepstakes, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.
GENERAL CONDITIONS: If for any reason the Sweepstakes, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, pandemic, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, health concern or emergency, or any federal, state or local government law, order, regulation or recommendation, order of any court or jurisdiction, or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Sweepstakes (each a “Force Majeure” event), Sponsor reserves the right at its sole discretion to disqualify any individual Sponsor deems responsible and Sponsor further reserves the right to cancel or terminate the Sweepstakes (or portion thereof). In the event the Sweepstakes is cancelled or terminated as a result of a Force Majeure event, Sponsor reserves the right to select the potential winners in a random drawing from among all eligible entries received up to time of such event. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, cable, satellite, servers, network or Internet service provider (ISP), computer equipment, software, failure of any entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sweepstakes entries generated by a script, macro or other mechanical or automated means and entries made by any means which subvert the entry process are ineligible and will be disqualified. In the event of dispute as to the identity or eligibility of a winner based on a email account, the winning entry will be declared made by the “Authorized Account Holder” email account submitted at the time of the entry. The Authorized Account Holder is the natural person who is assigned to the email address.
ADDITIONAL TERMS: By entering, entrant agrees to accept and abide by these Official Rules and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation or award of prize, shall be resolved by GMR and/or Sponsor, whose decision shall be binding and final. By entering, entrant agrees to be notified using the contact information provided in the entrant’s Entry by the Sponsor and/or GMR for the purposes of the administration of this Sweepstakes. By participating, entrant agrees to release and hold harmless the Released Parties from any injury, loss or damage to person, including death or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of a prize (including any travel/activity related thereto), participation in any Sweepstakes-related activity, or participation in the Sweepstakes. Sponsor is not responsible for any typographical, printing, or other error in the printing of these Official Rules, or any network, computer, mechanical, electronic, human or other errors or problems in connection with this Sweepstakes, including, without limitation, any errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries or emails, or in the announcement of prizes, including such error that may give an erroneous indication that a prize has been won. All entries become the property of the Sponsor and are not returnable.
DISPUTES/GOVERNING LAW: All disputes concerning the construction, interpretation, validity, effect, and enforceability of these Official Rules will be governed by the laws of the State of New York without regard to conflicts of laws provisions. Entrant (i) agrees that exclusive jurisdiction over any legal action arising out of or in connection with the Sweepstakes will be in state or federal courts located in or nearest to the State of New York, U.S.A., and by entering consents to such jurisdiction and venue; (ii) consents to resolve any such claims individually and without resort to class action; and (iii) agrees that all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees or punitive, incidental, consequential, or any damages other than actual out-of-pocket expenses.
